What is document automation for personal injury firms?

Document automation for personal injury firms is software that produces the documents a PI file runs on from the papers already on the file, rather than from a fee earner retyping them into a precedent. In PI the documents are contested, so the automation has to satisfy CPR Part 32, PD 32 and the relevant pre-action protocol, and it has to keep its facts traceable to the evidence.

With fixed recoverable costs and falling claim volumes, the economics of a PI department now turn on the time per file. Drafting is the largest controllable block of that time, and the contested documents are where it concentrates.

LegalDocs Assist covers RTA and credit hire, employers’ liability and occupiers’ and public liability, with 133 UK credit hire and motor claims authorities in the RTA and credit hire library alone.

The PI documents it drafts

Witness statements

CPR Part 32 statements assembled from call notes, accident report, engineer report, hire agreement, payment pack and pleadings, with fifteen format checks before export.

Impecuniosity assessments

A full Lagden analysis from the claimant’s bank statements, with committed outgoings identified from the printed payment types and every figure traced to a row.

Liability assessments

Structured recovery percentages, Highway Code reasoning and the investigation questions to answer before conceding anything.

Basic hire rate work

Automated interrogation of the insurer’s report on locality, vehicle class, transmission, terms and unsupported reductions, then a drafted reply.

Letters of claim

Protocol-compliant letters assembled from the chronology and the evidence actually on file.

Mitigation and need

Need for hire built from the claimant’s own words in mitigation statements and call notes, with source conflicts surfaced for the fee earner.

The evidence rules built into it

  • Hire daily rate, hire period and total hire cost come only from the hire documents, never from the defence.
  • Ownership is proved from the V5C, not from the pleadings.
  • The claim number is read from the particulars or the defence, and left blank where the claim is unissued.
  • Claimant-voice material leads on need for hire; the particulars do not overwrite the witness’s own account.
  • Hire days are counted inclusively, and figures that cannot be evidenced are withheld rather than estimated.

Why this matters under fixed costs

Motor injury and OIC volumes have fallen to record lows, and the files that remain are harder. Fixed recoverable costs mean a longer file is not a better paid file, so the department’s margin is set by the time each document takes and by how often a document fails.

Both halves of that need addressing together. Faster drafting alone raises the risk of a statement that does not survive challenge, which is why the compliance checks and source attribution sit in the same workflow as the speed.
